Terms of Service

Welcome to CirCow. These Terms of Service ("Terms") govern your access to and use of the CirCow website (circow.com), desktop client, AI worker marketplace, and related services (collectively, the "Service") operated by Xiamen Mitukes Technology Co., Ltd. ("CirCow", "we", "us", or "our").

By creating an account, downloading the client, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

CirCow operates an AI worker marketplace where users can browse, install, and run AI agents ("Workers") on their personal computers. Workers are software bundles that combine large language models, prompts, tools, and skills to automate productivity tasks.

2. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information.
• Keep your password confidential and notify us promptly of any unauthorized use.
• Be responsible for all activity that occurs under your account.
• Be at least 18 years of age, or the age of majority in your jurisdiction.

3. Subscriptions and Billing

CirCow offers free and paid subscription plans. Paid subscriptions are billed in advance on a monthly or annual basis and processed by our PCI-DSS certified payment partner. You authorize us (and our payment processor) to charge your payment method on each renewal date until you cancel.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. For refund eligibility, see our Refund Policy.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right.
• Generate, distribute, or facilitate the creation of NSFW, sexually explicit, or sexually suggestive content.
• Generate deepfakes, face-swap content, or impersonate real persons without consent.
• Engage in fraud, phishing, spam, or any deceptive practice.
• Distribute malware, viruses, or any malicious code.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service except as permitted by law.
• Resell, redistribute, or sublicense the Service without our written consent.
• Use automated means to scrape, harvest, or collect data from the Service in violation of our policies.

5. AI Workers and Third-Party Models

Workers may rely on third-party AI models (such as Claude, GPT, Gemini, or others). We do not control these third-party services and are not responsible for their outputs. You are responsible for reviewing and validating any output before relying on it for important decisions.

You are solely responsible for the prompts you submit and the content you generate. CirCow does not endorse and is not liable for user-generated content.

6. Intellectual Property

The Service, including all software, text, graphics, logos, and trademarks, is owned by Xiamen Mitukes Technology Co., Ltd. or its licensors and is protected by international copyright and trademark laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. You retain all rights to the content you create using the Service, subject to the rights you grant us to operate the Service.

7. User Content

You retain ownership of any content you submit to the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process it solely for the purpose of operating the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI-generated outputs will be accurate, reliable, or fit for any particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, CirCow and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless CirCow, its affiliates, officers, and employees from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections 5–11 and 13–16 survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the People's Republic of China, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the competent courts of Xiamen, Fujian, China.

15. Consumer Rights

If you are a consumer residing in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer-protection laws, nothing in these Terms limits or excludes any rights you have under those laws. You may bring claims in the courts of your country of residence where required by applicable law.
